Ohio State issues statement regarding alleged rape in Steubenville

Ohio State released a statement Friday regarding an alleged rape that occurred in Steubenville, Ohio, a town of about 18,000.

Steubenville, which is located just less than 200 miles from Columbus, finds itself in the national spotlight after two 16-year-old Steubenville High School football players, Ma’lik Richmond and Trent Mays, were charged with raping a 16-year-old girl at a string of parties in August.

“Sexual assault is a terrible act of aggression and violence, and our hearts go out to all victims,” the statement reads. “The situation in Steubenville is particularly disturbing, and our thoughts are with those affected.”

In particular, OSU’s release comes after a video taken on the night of those parties started to make its way around the Internet Wednesday.

The video, which can be found under different names on YouTube, features Michael Nodianos, a Steubenville High School graduate and former OSU student, talking and laughing about the alleged rape for more than 12 minutes amid a group huddled in what appears to be a living room.

Nodianos, who has not been accused or charged of any crimes, could not be found on “Find People,” OSU’s staff, faculty and student directory, Friday, though such information (his name, university email address and major) was accessible Thursday.

Nodianos did not respond to The Lantern's request for comment. 

While the university cites that it is “not at liberty to comment” because of Family Educational Rights and Privacy Act (FERPA) regulations, the school confirmed through its statement that “the student in question” was in attendance at the university “only through Dec. 12.”

According to “Find People,” Nodianos was an electrical and computer engineering major.

Nodianos, a former Big Red baseball player, according to a nearly 6,000-word story in the New York Times, opens the video by making “she’s deader than” analogies regarding the alleged victim, who did not die, but was reportedly unconscious during the alleged rapes.

According to the Times, Richmond and Mays are under house arrest and awaiting a trial that has been set for Feb. 13.

Nodianos was on an academic scholarship at OSU and has never had any connection with any athletic team muchless the football team. He didn't rape anyone and will not be called as witness because he easnt present during the rape. The alleged rapists were Steubenville high school football players and the rape occurred in Steubenville; not on OSU's campus. From what I can gather, the video was made in Steubenville before classes started.

The rapists will hopefully spend the next 25 years of their lives in jail for what they did...and I am certain they will have the opportunity to find out all about rape in prison. As for Nodianos, he is clearly guilty of hate speech, but since he did this video before he enrolled, I doubt that OSU can do much about it.

No woman that googles him will ever go out with this guy....guys wont hang out with him either. He will be completely, totally ostracized if he ever returns. This may be the best punishment of all

OSU's Facebook page announced today that he is no longer a student at the university. For everyone speculating that OSU was dodging the question as school was out for winter break, school is now back in session. Please note that this individual was not affiliated with the OSU football team, and was merely just a student (one of over 60,000 students).

Nodianos was not associated with Ohio State football ever in any way, shape, or form. Though he apparently played football at Steubenville High, he wasn't even a serious recruit by any team at any level of college football.

Facts are stubborn things.

Clearly the university needs to make a clearer statement as to this student's status once the new semester starts. This statement looks like exactly what it is, a dodge.

I know that everybody is mad at the person who record it. However if he hadn't done that she wouldn't have known who had raped her. She had passed out and didn't know what had happened to herself. We have to know kids are afraid to not be in the crowd. So, i think he taped this so people would know who raped that girl

Is there no honor code at Ohio State? I am a university professor and every university I have ever attended or worked at had an honor code. The existence of this video on the internet, and the misogynist things this student was saying in that video, would be sufficient for expulsion anywhere. Why is OSU claiming it has nothing on which to act?

An Honor Court would allow the student a rebuttal statement to charges of having violated an honor code. Why is none of this happening? This student has been at the university for a full semester since the incident. This is inexcusable.

I just signed the petition. Nodianos clearly knows that a rape is taking place in the video and HE TALKS ABOUT RAPING HER HIMSELF. WHY IS HE NOT IN POLICE CUSTODY? Oh that's right - because the Sheriff and the DA in Steubenville are corrupt and are covering up for all these guys, hence the national intervention.

I congratulate The Lantern for following this story. Nodianos is a violent sex offender - students at OHS should be afraid of him. The OHS administration should be afraid that he could rape a student or worse.

Just to also add to what Student13 is saying, maybe the university can't label him as a "current student" because classes haven't started yet. He may be is signed up for classes, but I know people don't always come back for the next term. So yes, technically he was in attendance until the 12th. If he doesn't turn up in the first week--for whatever reason--*then* he becomes a "former" student.

Isn't there a student judicial body at Ohio State, that could essentially review the tape and determine if Mr. Nodianos should be brought before the body. His statements must fall under some section of the university's code of conduct.

If nothing else Michael Nodianos is 'guilty' of moral turpitude. He should not be given the privilege of being enrolled as a student at OSU. If he is allowed to stay, he should be shunned.

The OSU is obviously right that "the release of further information is protected under FERPA and if he remains a student he has a right to due process from the University whether or not we like it", but they could start doing more without infringing on the defendant's rights. Stating their intentions to address the evident culture of sexual abuse within their football team would be a start. CHanging their policy on giving scholarships to violent meat-heads solely to boost their sports stats would be a longer lasting solution.
