Ohio State responds to Steubenville rape case

Ohio State finds itself a sideshow to an alleged rape that has forever changed an Ohio River-town and garnered national attention in recent weeks.  
Steubenville, Ohio, which is about 150 miles east of Columbus, is in the spotlight after two 16-year-old Steubenville High School football players, Ma’lik Richmond and Trent Mays, were charged with raping a 16-year-old girl at a party last August.

While neither Richmond nor Mays attend the university, OSU has been pulled into the case in light of a video taken from the night of those parties, which features former OSU student and Steubenville High School graduate Michael Nodianos, talking and laughing about the alleged rape for more than 12 minutes.

The video, which can be found on YouTube under the title “Michael Nodianos confession #oprollredroll #occupysteubenville Steubenville rape case,” shows Nodianos wearing an OSU T-shirt making analogies that the alleged victim was “deader than” or was “raped harder than.”

After the video gained more than 270,000 views and a Facebook group titled “OSU expel Michael Nodianos ‘Rape Crew’ member” garnered more than 2,600 “likes,” OSU issued a statement Friday addressing the situation in Steubenville and the university’s connection to it.

While the university would not comment on the case because of Family Educational Rights and Privacy Act (FERPA) regulations, the school confirmed through its statement that “the student in question” was in attendance at the university “only through Dec. 12,” the last day of OSU’s Fall Semester final examinations.

OSU spokeswoman Gayle Saunders would not confirm whether Nodianos is enrolled for Spring Semester or if he left the university.

The school is not the only public entity to respond to the flood of information surrounding the still-unraveling case.

A website titled “Steubenville Facts,” which is sponsored by the City of Steubenville and Steubenville Police Department, was created Saturday in an attempt to separate fact from fiction regarding the case.

While the site does not address Nodianos by name, it does touch on the viral video in which he plays a part in a post headlined as “Governance, Jurisdiction and Ohio Law.”

Though Nodianos does not face criminal charges for his 12-minute commentary, some have argued that he should answer to some semblance of disciplinary measures.

The website, however, attempts to dismiss that notion.

“Nothing in Ohio’s criminal statutes makes it a crime for someone to ridicule a rape victim on a video or otherwise say horrible things about another person,” the post reads. “Steubenville Police investigators are caring humans who recoil and are repulsed by many of the things they observe during an investigation … they are often frustrated when they emotionally want to hold people accountable for certain detestable behavior but realize that there is no statute that allows a criminal charge to be made.”

Dan Tierney, a spokesman for Ohio Attorney General Mike DeWine, whose office is prosecuting the case, told The Lantern that the investigation of the matter is ongoing.

“We cannot comment whether any additional charges are being considered, or if additional charges have been ruled out,” Tierney said in an email.

DeWine, who told 10TV he watched the video in its entirety, called it “disgusting” Friday.

“We will prosecute anyone who we believe is guilty of a crime. That’s all I can say at this point,” DeWine told 10TV.

Like DeWine, Adam Martello, a Steubenville native and third-year OSU student in economics, found the video jarring.

“It’s disgusting,” said Martello, a graduate of Steubenville Catholic Central High School. “The longer you watch it, the angrier you get. It’s vile.”

Martello, though, wasn’t sure that Nodianos deserves to face criminal charges.

“I’m a firm believer in the justice system we have and I don’t think that people should be charged just because people want them to be charged with something,” he said. “If he committed a crime, then he should be charged.”

While Nodianos did not respond to The Lantern’s request for comment, “Find People,” the school’s faculty, staff and student directory, showed on Thursday that Nodianos was a student in electrical and computer engineering. His information in “Find People,” however, has been rendered inaccessible since Friday as his name no longer yields results.

According to The New York Times, Richmond and Mays are under house arrest and awaiting a trial that has been set for Feb. 13.

Ohio State football culture can't be much different than Stuebenville. Ohio is a football worshiping state and it all starts as early as pee-wee leagues in small towns. I grew up in south east Ohio and it was the same there in the 80's as is being reported now with the exception of easy access to media tools and the Internet. I heard some football jocks make similar comments about girls in the hallways of my high school. The football coach was infamous for having a "favorite" female student every year. This is not much different than Penn State. The worship of the sport will be the downfall of any school.

Hey, my sons grew up in Steubenville, Ohio, and one is now an attorney and the other a pharmaceutical sales rep. They graduated with classmates that are doctors, nurses, teachers, etc so please know that there are mostly great folks in Steubenville and their children have gone on to be large contributors to society. This is an extreme embarrassment, and only involves a small faction of people in the town and has gone on for years that would include that coach, his brother, the entire half assed school, the prosecutor, and many business people tied to that school. They feel entitled and have always done what they wanted to do above or below the law. Most of the players took steroids and growth enhancement drugs, and most could not spell cat if you spotted them a C and T. When the culture of this small entitled group totally comes out in this deal, if you think you are shocked now just wait, and I look forward to their demise. Please realize that most of the town are hard working, viable, contributing citizens, and do not address it as a Steubenville problem, but a Big Red/Saccoicca problem.

Karma is hell. The people in the video, all of them, need to suffer some kind of consequences that if not by law, they should volunteer to do. Otherwise, they will be tainted their entire lives.

And what about the parents who are supposed to be the teacher of ethics to all involved? SHAME on them.

Also as one who grew up in E Ohio, I am outraged at the comments by the poster above who made derogatory comments about the people of the area. Anywhere you live, there are always a few bad apples.

Hoping for justice for the rape victim. And praying that all of those involved learn a severe lesson, whether they are prosecuted or not....like finding a conscience and learning some morals.

what is up with football players thinking the reserve the right to rape girls. Im a student at the University of Montana and there has been many rapes that have occured in the past couple years and they are committed by members of the football team....somehow, i think that coaches hold these players up high...so high that they feel they are above the law. I'm embarrassed to say that i attend this University.

Now you see why I have been VERY hard on my daughters (one a Buckeye alum) not to drink and fall out drunk with a bunch of animals at parties..BE CAREFUL !! Even in the military I had a roommate who was a drunk and mistreated me BUT guess who she wanted to testify on her behalf when she yelled rape???? I saw the video and I felt bad for the parents of these idiots who think such jokes are funny. Even sadder I've NEVER heard a male say "Man this is wrong leave this girl alone!!" If guys think you're a slut they will let EVERYONE have you for dinner.......let justice handle this and leave Osu OUT OF IT!!!!!

I am the relative of a college student who was raped and was murdered on a college campus. They still have not found her murderer, and initially the University tried to sweep the whole thing under the rug. It was only a lot of sustained pulic outcry that made the police begin to really investigate her disappearence. When you have a culture that thinks that women are soiled by rape, that they deserve rape, and that it is funny if they are killed while being raped, we are wose than the Talian. The males who did this and the creature who laughed about it have been protected by their community. Why should they have the benefit of scholarships? How on earth were they protected by their coaches and the local DA and the sheriff? This is not individual--this is cultural. The worst part of this is that these creatures outed themselves by videotaping their acts to record their "kill" and to fuher humiliate the victim. Who knows how many other people they have abused. What else have they done? This nest of sociopaths needs to be cleaned out. Dont know if the moron from Ohio state committed rape. Do know that he vilated every standard of behavior of every school I have ever heard of. Sure doesnt eem liek scholarship material.

Why am I not surprised that something like this would happen in Steubenville? The residents of that area of Ohio are inbred outcasts that West Virginia wouldn't tolerate. Let's hope they get what they deserve, whether from Bubba in prison, or a vigilante who's had enough.

I hope someone who's actually on campus like his roommates or classmates will report back and let us know if he's actually come back to school or not. Tired of this shilly-shallying about whether or not he is still a student. If there's a potential rapist in the midst of the student body, students and parents have a right to know.

You can hate on OSU all you want, but you have to let them follow the law. As vile and disgusting as this whole situation is, none of this occurred on OSU grounds, and the OSU student in the video has not been charged. I hope he does not come back to campus. However, what I don't want is for OSU to make a sudden move that would put them in a position to be sued by this piece of crap student who would them walk away with a ton of money. THAT would be wrong on so many levels. Give justice time. Give OSU time to figure things out. They have to tread lightly and do things the legal way.

I was born and raised in this area, it highly disgust me to know that there are such sick people that also call the valley their home. These stupid and sick kids are definitely not the representation of the folks from the ohio valley. What everyone is losing site of is that this is an eye opener to what type of sick individuals that walk among us everyday. I think that not only should the indiviauals get the maximum sentence but I think that all the parents should be held liable too....I agree with the person earlier...if you witnessed it and did nothing then are just as guilty

Just because the corrupt local Government tried to cover this up and only charged 2 black students with the crime while not touching the better connected white students doesn't mean that after watching the video he posted confessing to the rape and being an accessory to the rape HIMSELF should be grounds to allow him to continue on in his sociopathic ways. It is obvious that he fully approves of drugging women, raping them, and even finds the fact that they may be dead HILARIOUS! Frankly anyplace that ignores this evidence and looks the other way may not be worth a second look or any further donations.

I don't understand why he isn't liable in some way, particularly if he is boasting while the rape is ongoing. What a sick, sick individual and sick community. I am sure that there are good people in Steubenville but it sounds like something is very wrong with the football culture there.

He should be dismissed from Ohio State. Why would any parent want to send their daughter there, knowing that the University knows what he's like and allows him to stay. I'm a proud OSU grad as are my brother and sister, and I hate to think this could have been one of our children who was attacked. Also, there should be a record at OSU of the 16 year old rapists names. At age 18 their juvenile records will be sealed and they could get into school. There are consequences for their action.

This is exactly why other countries look at us as barbaric slobs. Michael Nodianos, along with all of the other members of the rape party, congratulations on completely obliterating any sort of future you may have had, before you even had a chance to start it. I'm not an overly religious person, but I find comfort in knowing the fate that will be bestowed upon you come judgement day.
