A grand jury will decide this week if it will indict the operator of a crane that fell and killed a man in July during work on the Schottenstein Center, said Dan Cable, assistant Franklin County Prosecutor.Marvin Kuhn, 45, of Columbus, was killed when the boom of a crane fell on his car. The accident occurred the morning of July 21 on Lane Avenue.Mark Burcher, 38, of Westerville, was the crane operator. The prosecutor’s office decided on Oct. 9 to take the case to a grand jury, said Cable. He has handled the case since the accident occurred.PJ Dick Inc., the construction company in charge of the project, owned the crane. They also owned the crane that damaged the Richard and Annette Bloch Cancer Survivors Plaza on Lane Avenue on May 21.The company was fined $5,625 by the Occupational Safety and Health Administration in September in connection with the accident that killed Kuhn.
